As we observe Hispanic Heritage Month from September 15 to October 15, it’s an opportune time to reflect on the evolving landscape of immigration policies in Texas and their impact on our communities.
Senate Bill 4: A Turning Point in State Immigration Enforcement
In December 2023, Texas enacted Senate Bill 4, empowering state law enforcement to arrest individuals for illegal entry into the state. This legislation introduces a new state misdemeanor for unauthorized border crossings, punishable by up to six months in jail. Repeat offenses could lead to second-degree felony charges, carrying sentences of up to 20 years.
While the law aims to bolster immigration enforcement, it has faced legal challenges. In January 2024, the U.S. Department of Justice filed a lawsuit, arguing that SB 4 violates the Supremacy Clause of the U.S. Constitution. Although the Supreme Court allowed the law to take effect temporarily, its constitutionality remains under scrutiny.
